Important Information
Terms and Conditions of Sale and Warranty
-
Prospective buyers wishing to participate in the auction must register prior to the sale by providing full contact details (name, address, phone numbers) to the auction manager. The prospective buyer will receive a paddle number to serve as identification.
-
Registration for the auction confirms that the prospective buyer has read and agrees to all the terms and conditions of sale outlined below.
-
All items listed for sale in this catalogue are sold "as is," and no returns will be accepted based on condition. Most items are of considerable age and will exhibit wear, use, and damage that is often not listed in the catalogue. The absence of condition notes does not imply that the item is in perfect condition. Prospective buyers or their agents are responsible for assessing the physical condition of all items. No employee or agent of Hammersite is authorized to make any representation or warranty, orally or in writing, regarding any item. Therefore, if a prospective bidder has not examined the item to their satisfaction prior to the sale—or had an agent do so—Hammersite recommends not placing a bid. All measurements are approximate. Condition is not guaranteed.
A. Items Over 250 Years Old:
All items over 250 years old are subject to export regulations and requirements. It is the sole responsibility of the prospective buyer to ensure that any item over 250 years old (an “antique”) successfully bid upon or won via Hammersite auctions may be lawfully imported into the buyer’s country of residence. Buyers must conduct their own due diligence, including but not limited to consulting relevant authorities, legal advisors, and customs departments to confirm the legality and requirements for importing such antique items.
Hammersite will not be liable for any law, restriction, penalty, or confiscation arising from the import of antique items into the buyer’s country. Hammersite makes no representation or warranty regarding the legality of importing such items and will not be involved in any dispute or resolution regarding import restrictions or violations.
The buyer agrees to indemnify, defend, and hold harmless Hammersite, its subsidiaries, officers, directors, employees, agents, and representatives from any claims, liabilities, damages, and/or costs (including, but not limited to, legal fees) arising from the buyer’s noncompliance with relevant import laws and regulations regarding antique items.
Any condition description or statement is provided as a courtesy and constitutes opinion only and should not be considered a statement of fact. Hammersite shall not be held responsible for any error or omission. The absence of a condition statement does not imply that the item is in perfect condition or free from wear, defects, or aging. Items listed in this catalogue will be offered by Hammersite as owner or as agent for the consignor(s) subject to the following terms and conditions. By placing a bid at auction, you agree to be bound by these terms of sale.
-
Neither the auctioneer (“Hammersite”) nor the consignor makes any warranties or representations of any kind with respect to the property, and neither shall be liable for the accuracy of author, attribution, origin, period, culture, source, or condition of the items. No statement made at the sale, in the invoice, or elsewhere shall be deemed as a guarantee or representation of liability.
-
A painting is considered attributed to an artist if the artist's name appears before the title in the catalogue. If a buyer believes that the artwork purchased is not by the artist to whom it is attributed, a written notice must be submitted to the auction manager within 30 days of the auction date, along with proof of claim no later than 14 days after such written notice. If the claim is substantiated to the satisfaction of the auction manager, the full purchase price (excluding interest) will be refunded to the buyer, provided the item is returned in the same condition as when sold. Claims submitted after this period will not be accepted.
Terms & Conditions
-
To participate in the auction via telephone, absentee bid, or through a selected bidding agent, the buyer must contact the auctioneer at least 24 hours before the sale and complete the necessary paperwork.
-
The highest bidder, as determined by the auctioneer, will be the buyer. In the event of a disputed bid, the auctioneer will have the sole discretion to determine the winning bidder.
-
Most items will have a reserve price set below the low estimate.
-
The buyer will pay the hammer price plus a buyer’s premium and any applicable tax. The buyer’s premium is a fixed 22%. Online bidders using platforms other than BidSpirit will be charged an additional 5% live bidding fee on the hammer price.
-
Any item purchased by a foreign citizen, paid in foreign currency, and shipped directly overseas is exempt from VAT.
-
All catalogue and auction prices are listed in U.S. Dollars. Payment shall be made to the auction manager in U.S. Dollars or New Israeli Shekels.
Accepted payment methods:
a. Check – Auctioneer reserves the right to withhold items until check clearance. Only Israeli checks are accepted.
b. Cash – Payments in USD or NIS are accepted (subject to regulatory limits on cash transactions).
c. Credit Card – Auctioneer accepts credit card payments for purchases via Visa, MasterCard, or American Express only. All credit card transactions incur a 1.2% fee on the total purchase price (hammer + buyer’s premium + VAT, if applicable).
Note: New clients without prior registration with Hammersite may pay only via bank transfer or cash. Credit card transactions will be allowed after credit verification.
-
Unless otherwise agreed with the auctioneer, all purchases must be paid for and collected by the seventh day following the auction. If a purchased item is not paid for or removed within this time frame, the auctioneer may charge the buyer for insurance and storage (at $10/day), retain the item or other items purchased by the buyer, apply any payments to cover outstanding amounts, or resell the item.
