Terms & Conditions

(filed with the Registry of the District Court of Amsterdam, Deed of Deposit No. 388/1989, by the Dutch Organisation of Brokers, Auctioneers and Sworn Appraisers in Movable Property and Machinery).

Article 1

These terms and conditions apply to all our auctions unless expressly stated otherwise in a catalogue or announced at the start of or during an auction.

 

Article 2

The applicability of the terms and conditions will be made known to auction visitors. Anyone participating in an auction thereby indicates their full acceptance of the applicability of these terms and conditions.

 

Article 3

The sale is concluded upon final allocation. All goods are sold as is, i.e. in the condition they are in at the time of allocation. After allocation, goods are entirely at the expense and risk of the buyer.

 

Article 4

Descriptions in the catalogue and all written or verbal information are provided by the auctioneer and his staff to the best of their knowledge. The auctioneer accepts no liability for incorrect descriptions or incorrect information, except as provided for in Article 5 of these terms and conditions.

Article 5

Unless expressly excluded for certain goods in the catalogue, contrary to the provisions of Articles 3 and 4, the auctioneer is prepared to take back an auctioned item against simultaneous refund of the purchase price and auction costs charged, if, within a period of three weeks after the sale, the buyer proves to the satisfaction of the auctioneer that the auctioned item has such serious hidden defects or that the description provided is so incorrect that, if these defects or the correct description had been known to the buyer at the time of the sale, he would have refrained from purchasing or would only have purchased at a significantly lower price. The auctioneer is not prepared to take back the item if the description in the catalogue was revoked during the auction and the correct description was communicated verbally to the public. The willingness to take back the item also lapses if the buyer is unable to return the auctioned item in the same condition as it was in at the time of allocation.

Article 6
The buyer is deemed to have purchased for himself and is liable for payment without being able to invoke a principal.

Article 7
The auctioneer and the auctioneer reserve the following rights:

to refuse persons as bidders or buyers without giving reasons;
to change the order of sale at any time;
to cancel or add lots;
to combine or split purchases;
not to award purchases or to suspend them;
to correct errors in bids and allocations, without a bidder being allowed to take advantage of such errors;
to demand full or partial payment upon first request after the allocation of a purchase, while in the event of refusal or inability to pay, the auctioneer and the auctioneer's assistant have the right to re-auction the item in question and not to accept the bid of the defaulting bidder again;
to re-auction goods if the buyer refuses, upon first request, to disclose their full name and address to the auctioneer and to show relevant identification;
not to transfer goods from the account of the original buyer to that of another;
not to hand over goods during the auction;
to place bids on behalf of buyers or sellers;
to re-auction goods that are the subject of a dispute during or shortly after the auction.

Article 8

Payment of the purchase price plus any premium, number money, other costs and any VAT, all to be determined by the auctioneer, must be made in current Dutch currency prior to delivery of the purchased goods, unless otherwise permitted, within the period to be set by the auctioneer, without any discount or set-off. In the event of late payment, the auctioneer may charge the buyer interest at a rate equal to the statutory interest rate plus 3%, calculated from the date of allocation until the date of payment. All judicial and extrajudicial costs shall also be borne by the defaulting buyer, with a minimum of €120 or, at the sole discretion of the auctioneer, a minimum of 15% of the purchase price plus the auction costs.

Article 9
If a buyer exceeds the payment term, he is in default by virtue of this fact alone and the auctioneer has the right, without any further notice of default, to consider the sale null and void and dissolved by operation of law. Any partial payments shall then be forfeited to the auctioneer, who shall also be entitled to recover damages and costs from the buyer and to re-auction the auctioned item immediately or at a later date or to sell it privately. The defaulting buyer shall remain liable for any lower proceeds and for the costs of this sale, while he shall not be entitled to claim any higher proceeds. The auctioneer is also entitled to demand performance in and out of court, as well as compensation. Ownership of the purchased goods shall not transfer until full payment of the purchase price and the costs referred to in Articles 8 and 10.

Article 10
The buyer is obliged to take possession of the purchased goods and to collect them (or have them collected) within the period specified by the auctioneer. Except for the auctioneer's right to specify a shorter period, the latest collection date is five working days after the last auction day. If the buyer fails to take delivery of the purchased goods and collect them (or have them collected) within the specified period, the buyer will be in default and the provisions of Article 9 will apply mutatis mutandis. The auctioneer also has the right to place the purchased items in storage at the buyer's expense and risk, with the buyer being liable for the costs of storage and transport, as well as the associated risk.

Article 11
The auctioneer may accept bids from prospective buyers and may impose further conditions on these bids. Neither the auctioneer nor its staff can be held responsible in any way for omissions or errors in the execution of bidding instructions. The auctioneer has the right to refuse bidding instructions and to demand full or partial payment upon acceptance of a bidding instruction. The auctioneer also has the right to refrain from executing a bid order if the description in the catalogue of the item to which the bid order relates is revoked during the auction and replaced by another description. These terms and conditions apply in full to a purchase made by executing a bid order.

Article 12
The auctioneer is not liable for any accident or damage suffered by anyone in or near the buildings or grounds where viewing takes place, where the auction is held or where the goods sold are collected, except insofar as covered by the auctioneer's insurance. Entering the buildings or grounds is at your own risk.
